For many South Africans, Human Rights Day is meant to symbolize freedom, dignity, and equality. However, for the Khumalo family of Farm 20, Olifantsfontein, Ward 01, City of Ekurhuleni, it serves as a Painful reminder of deep-seated injustices, systemic racism, and economic oppression that persist decades after the end of apartheid.
Betrayed by the System: A Story of Dispossession
The Khumalo family has faced relentless legal and economic attacks, culminating in homelessness and financial ruin—all rooted in the same apartheid-era capitalist doctrines that continue to govern South Africa’s institutions. Standard Bank Limited, established in 1862, and its executives, Ben Kruger and Sim Tshabalala, have allegedly been instrumental in perpetuating economic exclusion, working alongside white European-owned law firms and corrupt legal entities to exploit loopholes and deprive African families of their rightful properties.

Through a fraudulent and unconstitutional sale, the Khumalo family lost their fully paid home—valued at R2,485,000.00—for a mere R288,000.00. The sale was orchestrated with the assistance of Deputy Sheriffs and major law firms, including:
✔ Findlay & Niemeyer Attorneys (Established 1892, Pretoria)
✔ Van Hlystens Attorneys (Established 1872, Sandton)
✔ MacRobert Attorneys (Established 1896, Pretoria)
✔ MD Mitchell Attorneys (Pretoria)
These legal institutions allegedly fabricated fraudulent claims to dispossess the family of their property, reinforcing the notion that African lives and assets remain disposable under a system still controlled by colonial-era principles.

Legal Manipulation and Unanswered Cases
The injustice does not end with property dispossession. In 2009, under Case Number: 23787/2009, the North Gauteng High Court in Pretoria issued a default judgment against the Khumalo family—without ever serving them with summons. White individuals involved in the case allegedly lied under oath, making false claims that do not exist in reality.
In their pursuit of justice, the Khumalo family has opened multiple criminal cases against those responsible:
- Case Number: 407/07/2010 (Olifantsfontein Police Station) – Theft and trespassing against Sonnyboy Dannyboy Barkly – No arrests after 15 years.
- Case Number: 393/01/2011 (Johannesburg Central Police Station) – Fraud, corruption, and theft – No arrests after 14 years.
- Case Number: 584/11/2013 (Brooklyn Police Station) – Robbery, GBV, fraud, human rights violations, and systemic institutional racism – Case was escalated to the National Prosecuting Authority on 9 January 2015, but Buhle Vilakazi refused to prosecute.
Despite irrefutable evidence, the South African Police Service (SAPS) and the judiciary have ignored these cases, allowing the perpetrators to walk free.

The Banking Scam: Promised Loans Never Received
Adding to the injustice, Standard Bank Limited and Standard Bank of South Africa Limited allegedly promised the Khumalo family loans totaling R2,437,148.38:
- 28 June 2007 – R488,646.00
- 4 July 2007 – R491,204.38
- 7 August 2007 – R1,457,298.00 (Mortgage Bond Contract Number: B196782/2007)
Despite formal agreements, the bank never disbursed a single cent of the promised funds. The Khumalo family reported the fraud to SAPS, but no arrests have been made.

The Fight Continues
For the Khumalo family, Human Rights Day is a cruel joke. After 31 years of democracy, they remain victims of systemic economic sabotage, institutional racism, and judicial corruption. Their story is not just about one family—it is about a country still shackled by the very forces it sought to dismantle in 1994.
It is time for urgent reform, accountability, and justice. Until then, Human Rights Day remains a hollow celebration for those who continue to suffer under a system designed to deny them dignity, justice, and economic freedom.
